Terms/Claims/Liens.

Unless specified in writing to the contrary, payment is 100% with order plus shipping/handling costs at the time the order is placed in though the website (https://store.scudopro.com). Claims for defects, damages, or shortages must be made by the customer in writing no later than 10 calendar days after order has been received.
If no such claim is made, Scudo Sports Wear LLC and the customer will understand that the product  has been accepted. By accepting the product, the customer acknowledges that the Scudo Sports Wear LLC performance has fully satisfied all terms, conditions, and specifications. Scudo Sports Wear LLC liability will be limited to the quoted cost of defective goods, without additional liability for special or consequential damages.


Manufacturing Time: Approximately and no more than 6 weeks once Scudo Sports Wear LLC has received payed online Order. There will be no liability or penalty for delays due to state of war, riot, civil disorder, fire, strikes, accidents, action of government or civil authority, acts of God, or other causes beyond the control of the provider. In such cases, schedules will be extended by an amount of time equal to delay incurred. 

Returns or Refunds.  The customer agrees that there will not be any returns or refunds accepted unless the items are defective or as indicated in the Return and Refunds section of this document. ALL SALES ARE FINAL.

Warranty.  Warranty does not cover normal wear, improper washing, improper sizing, damage caused by neglect or misuse, alterations or failure to follow manufacturer’s directions and product care guidelines. The manufacturer reserves the right to repair, replace or credit a defective item.



Liability Disclaimer of Express Warranties. Scudo Sports Wear LLC warrants that the work is as described in the purchase order. The customer understands that all sketches shown are intended only to illustrate the general type and quality of the work. They are not intended to represent the actual work performed.

Disclaimer of Implied Warranties. Scudo Sports Wear LLC warrants only that the work will conform to the description contained in the purchase order. Scudo Sports Wear LLC maximum liability, whether by negligence, contract, or otherwise, will not exceed the return of the amount invoiced for the work in dispute. Under no circumstances will Scudo Sports Wear LLC be liable for specific, individual, or consequential damages.

Indemnification. The customer agrees to protect Scudo Sports Wear LLC from economic loss and any other harmful consequences that could arise in connection with the work. This means that the customer will hold Scudo Sports Wear LLC harmless and save, indemnify, and otherwise defend him/her against claims, demands, actions, and proceedings on any and all grounds. This will apply regardless of responsibility for negligence. 
Personal or Economic Rights. The customer also warrants that the work does not contain anything that is libelous or scandalous, or anything that threatens anyone’s right to privacy or other personal or economic rights. The customer will, at the customer’s sole expense, promptly and thoroughly defend Scudo Sports Wear LLC in all legal actions on these grounds as long Scudo Sports Wear LLC: promptly notifies the customer of the legal action; and gives the customer reasonable time to undertake and conduct a defense. Scudo Sports Wear LLC reserves the right to use his or her sole discretion in refusing to print anything he or she deems illegal, libelous, scandalous, improper, or infringing upon copyright law.


Jurisdiction. The parties agree that all disputes arising under this agreement shall be governed by Texas law. The parties further agree that the Supreme Court of the State of Texas, Harris County shall be the sole and exclusive jurisdiction and venue in which any dispute arising under this agreement shall be determined.
 
 


Return & Refund Policy for Store orders

This policy only applies if the the product is purchased through our website https://store.scudopro.com with no custom modifications. The product must be as-is in the website. These conditions do not apply for full custom, semi custom or  store custom apparel.

Scudo Sports Wear LLC has a 30 day guaranteed exchange or refund on purchases made in the online store.

You will receive a refund or exchange for your purchase only if it meets the criteria in our Return Policy:

  • All items must be returned within 30 Days of the original purchase date.
  • All products must be in new, unused, and perfect condition, including the product tag.
  • All items must be returned in the original condition and packaging.
  • We will only handle refunds or exchanges in case that the apparel was purchased and paid directly to Scudo Sports Wear by the end customer.
  • Sales by third party vendors  will be handled by their own policies. ScudoPro will not be responsible for any exchange or refund from third party vendors.
  • Size Exchange:
      • If the garment is not the proper size, we will exchange to a new size (bigger or smaller) but using the same design that was previously purchased.
      • You are  entitled to ONE size exchange only, so we encourage you to be sure of the size that is needed based on our size charts.
      • Our sizing charts have a +/-3% tolerance.

       

      • Quality issues exchange
        • We will exchange your product if it originally arrives with manufacturing issues as: incorrect sewing, teared fabric, incomplete fabric, the design is not accurate compared to the one listed on the online store. It is understood that the package or its content were not damaged while in transport.
        • Used or mistakenly handled garments will not be replaced or refunded.
      • Fabrics and Materials
          • ScudoPro keeps a production and fabric standard for all the products that we produce, but we are not exempt to market changes from our suppliers, availability or any kind of material discontinuity.
          • ScudoPro reserves the right to change or exchange at any time, any of the materials as fabrics, zippers, thread or any other part of the product required to manufacture the product. Any material's replacement will be made with it's equivalent or a higher standard product without sacrificing quality or craftsmanship.

           

          • Shipping
            • You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are nonrefundable.
            • We rely on third-party couriers to deliver our goods as (but not limited to) FedEx and USPS. Scudo Sportswear will not be responsible for any misplacement of the package, delays or any damage to the item(s) that might occur while they are being transported. However, Scudo Sportswear is committed to our customer’s satisfaction and will help you manage your delivery claims.

          Refund:

          • If you do not wish to exchange the  product, you must return it letting us know that a full refund is requested.
          • Please allow 2 – 3 business days for credit to be applied to your account after receipt of the item(s).
          • The amount credited to your card will include price of item(s) and any taxes that were charged. Any shipping charges will not be refunded.
          • We will not refund if the product was damaged, mistakenly handled, or if a item was shipped back to us different to the one that you purchased

          Recommendations:

          • We recommend you return items via UPS ground or insured USPS for proof of delivery, or any by any other courrier that you trust.
          • We also recommend that you reuse the original shipping carton and packing materials when returning the goods.

            • If the garment is not the proper size, we will exchange for 50% of the price to a new size (bigger or smaller) but using the same design that was previously approved and purchased.
            • You are  entitled to only ONE size exchange, so we encourage you to be sure of the size that is needed based on our size charts or sample kits.
            • Our sizing charts have a +/-3% tolerance in the overall build.
            • If custom/tailored measurements are required, these must be notified and properly documented. Our custom size adjustment has  +/-5% tolerance.

           

          • Quality issues exchange
            • We will exchange your product if  it originally arrives with manufacturing issues as: incorrect sewing, teared fabric, incomplete fabric, damaged zipper or if the graphic design is not accurate compared the signed proof.
            • The design proof will indicate all important and relevant information that you must agree with. Any information or requests that have not been properly documented (Partial or completely) will not be considered as part of this criteria.
            • It is understood that the package or its content were not damaged while in transport.
            • Used, modified  or mistakenly handled garments will not be replaced or refunded.

           

          • Shipping
            • You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are nonrefundable.
